IBRU BROTHERS BATTLE OVER FEDERAL PALACE HOTEL

MORE  facts emerged yesterday on the last days of the late Mr Alex Uruemu Ibru, the frontline businessman and publisher of The Guardian, who died on November 28, last year.
The widow, Mrs Maiden Ibru, relived his last days in court where she has mounted a legal battle to wind up a company owned by her husband and his brother, Mr Goodie Ibru.
The matter came up at the Federal High Court, Lagos.
As Justice Okechukwu Okeke was about making his pronouncement on the submissions by the lawyers, he noticed that Mrs Ibru raised her hand, demanding to be allowed just two minutes to speak, a request the judge granted. At that point, the court went silent.
Mrs Ibru, who was accompanied by one of her children, Toke, told the court why she filed the suit.
“Six months before my husband died, the doctors told me that he was going to die. And for five months, he was out of circulation and nobody saw him and even his family members did not bother about him. 
“Two weeks before he died, he embarked on a hunger strike and when the family members heard about it, some of them came to see him, including Mr Goodie Ibru. When Goodie came, he (the deceased) said he did not even expect he could be talking. 
“Then my husband said he was going to fight him to the finish, dead or alive. That even when he dies, he was going to continue the fight, unless he (Goodie) resigned as the chairman of the company (Tourist Company Nigeria Plc).”
“He said out of all his brothers, the last person that he thought will betray him was Goodie. They had altered some of the company’s documents, diverted money and committed all sort of atrocities without the knowledge of my husband. I am a widow and have children to take care of,” she said.
Mrs Ibru said while entering the court, she saw her husband who, she claimed, encouraged her to proceed with her actions.
She alleged that her late husband was unhappy with Mr Goodie Ibru and had demanded that he (Goodie) quit his position in one of the companies they jointly owned.
Dressed in a black gown, Mrs Ibru spoke at the hearing of a winding-up petition her lawyer, Dr. Tunji Braithwaite, filed against Tourist Company of Nigeria Plc, jointly owned by her late husband and his brothers.
Mrs Ibru, who sued on behalf of Omamo Investments Corporation (a company owned by her late husband), is seeking to wind up Tourist Company, believed to own the Federal Palace Hotel, Lagos on ground of alleged indebtedness.
She stated in the winding-up petition that Omamo Investments, between 2003 and 2009, lent to the Tourist Company $7.1m, N610m, N381m and N19m, which the company has allegedly been unable to repay.
Mrs Ibru, who claimed to have made several demands on the respondent to no avail, prayed the court to wind up the company for allegedly being insolvent.
She stated that the respondent “has failed beyond resuscitation, has insufficient assets to meet its liabilities, does not have the capacity to meet the conditions for which it was incorporated and has suffered a total erosion of its capital base”.
“The respondent is both cash flow and balance sheet insolvent and has not been carrying on effectively, the business of hotelling and catering.” 
She averred that the whole substratum of the company is gone and it is impossible to carry on the essential purpose for which it was formed.
Mrs Ibru urged the court to wind up the Tourist Company under the provisions of the Companies and Allied Matters Act, CAP C20 LFN 2004 and appoint a provisional liquidator in the person of the President of the Chartered Accountants of Nigeria (ICAN) or his nominee.
But the respondent has denied Mrs. Ibru’s claim and asked the court to dismiss the suit on the ground of incompetence, adding that it discloses no reasonable cause of action and constitutes a gross abuse of the court process.
In a preliminary objection filed by  its lawyer, Onyebuchi Aniakor , the Tourist Company argued that  no grounds, as provided for by law, had been disclosed by the petitioner to justify the commencement of a winding-up proceeding against it.
It said the petitioner had not shown that the alleged indebtedness, the subject matter of the petition, was due for payment or payable by the respondent.
The respondent contended that as against the petitioner’s claim, no demand for payment on the alleged indebtedness had been made on it.
At yesterday’s proceedings, the presiding judge informed parties about a letter written to the court by Chief Edwin Clark and J.P Clark, two Delta State elder statesmen, praying the court to adjourn the case indefinitely for parties to explore amicable settlement options.
Part of the letter, read out by one of the court’s officials, reads: “As members of the family, the two parties are our relations. We will like the court to give us the opportunity to intervene and settle the matter amicably.”
Braithwaite urged the court to ignore the letter, arguing that the writers had nothing to do with the case and were not party to the petition.
Besides, he has written to the Chief Judge for the case to be transferred to another judge.
Aniakor, who agreed with Braithwaite that the writers of the letter were busybodies in the petition, said they were well-intentioned busybodies.
He said it was the duty of the court to promote amicable settlement of any dispute before it and that the recent development has provided the platform for such settlement in this case. 
Aniakor, however, left the final decision on the issue to the court.
Justice Okechukwu Okeke, after studying the court processes filed by the parties, noted that the case involved two brothers, an observation Braithwaite objected to, stressing that it was a commercial dispute between two companies.

DIAMOND BANK MOVES TO DECLARE SIR EMEKA OFFOR BANKRUPTS OVER N2 BILLION DEBT

Diamond Bank Plc has begun moves to declare an oil magnate, Mr. Emeka Offor, bankrupt following an alleged N2bn debt owed by his company, Chrome Oil Services.

According to a document obtained by SUNDAY PUNCH, the bank had granted a series of loans to Chrome oil which amounted to N750m, but the firm defaulted in the payment of the facility which had accrued to over N2bn by December, 2011.

Investigations further showed that the oil firm allegedly reneged on its promises to pay the loan contrary to the agreement it entered with the bank, before it was granted the facility.

According to the bank, after repeated demands to pay the debt, then in excess of N1.3bn, the company in October, 2006 made a proposal to the bank to pay N750m as final settlement within 12 months, through monthly instalments of N62.5m with effect from December, 2010.

"The bank accepted the offer on the condition that if the company failed to abide by the monthly payment agreement, the concession granted it would be cancelled and it would be liable to repay the total outstanding sum, including the interest suspended.

"It also threatened to sell the company's property in Asokoro, Abuja, which the company mortgaged to it. Offor who personally guaranteed the loan repaid only one instalment of N62. 5m within the 12 months limit that the company set out," the bank said on Friday.

When all efforts by the bank to recover the money failed, it served Offor, a chieftain of the Peoples Democratic Party and his company notice that the concession had been withdrawn and that the quantum of the indebtedness, with interest application that was hitherto suspended, had increased to N2bn.

A letter to Offor dated March 1, 2012, read, "Take notice that as a consequence of your company's unwillingness to repay its debts and in deference to your representation to the bank in the deed of personal guarantee, which you voluntarily signed and which it relied on to grant the loans that led to the debt, we hereby call-in your guarantee by demanding that you personally repay the debt within seven days from the date of the letter, failing which the bank will commence steps to declare you bankrupt for inability to repay your debts, to enable a liquidator to be appointed over your assets for it to recover its funds."

Offor could not be reached on Friday as he did not respond to several calls and a text message sent to his phone by our correspondent.

The text read, "Sir, I will like to get your comment on the moves by Diamond Bank to declare you bankrupt over a N2bn debt."

HOW SUNDAY TIMES JOURNALISTS NAILED AMOS ADAMU IN BRIBERY SCANDAL

 Nigeria's former FIFA member Amos Adamu has lost his appeal against a three-year ban over World Cup bid bribes.
The ruling from the Court of Arbitration for Sport (CAS) has confirmed the FIFA ban and even said that the sanction was 'relatively mild given the seriousness of the offence'.
Adamu was banned by FIFA's ethics committee following a Sunday Times investigation when he was secretly filmed by journalists, posing as lobbyists, asking for 800,000 US dollars to influence his vote for the 2018 World Cup.

CAS said in its ruling: 'The CAS panel stressed that it was of crucial importance that top football officials should not only be honest but should evidently and undoubtedly be seen to be honest.
'With respect to the behaviour of Dr Adamu, the CAS panel was comfortably satisfied that he was far from actively and unambiguously refusing the improper offer set forth by the alleged lobbyists.
'In conclusion, the CAS arbitrators considered that the sanction imposed by FIFA was not disproportionate and was even relatively mild given the seriousness of the offence.'
It is the first time CAS has been called on to rule on a sanction by FIFA's ethics committee.
Mohamed Bin Hammam, the former FIFA member banned for life last year for bribery, has also appealed to CAS and the hearing will take place on April 18 and 19.

LAGOS BILLIONAIRE, WALE BABALAKIN ARRESTED,DETAINED BY EFCC

  The Economic and Financial Crimes Commission (EFCC) last week arrested and briefly detained Wale Babalakin, a Lagos-based businessman, on charges of facilitating money laundering by former Governor James Ibori of Delta State.
The EFCC detained Mr. Babalakin overnight last Saturday and subsequently granted him administrative bail.
A source close to suspect, a lawyer whose company owns the new wing of the Ikeja domestic airport, told SaharaReporters that Mr. Babalakin was “shaken when the EFCC came for him,” adding that the businessman quickly contacted his political sponsors to arrange his “administrative” release.

NIGERIAN BILLIONAIRE BATTLES BRITISH WIFE OVER $21 MILLION DIVORCE PAYOUT

A wealthy Nigerian-born, British-based oil baron has been granted permission to use Nigerian tribal law to appeal a $21 million divorce payout to his former British wife, the Telegraph has reported.
Michael Prest, the 50 year-old founder of Nigerian energy trading firm Petrodel Resources, split from his wife in an acrimonious divorce in 2008. During a British High Court hearing on the divorce in October last year, the presiding judge ordered the tycoon to pay his former wife cash and assets worth over $20 million.

Folashade Okoya said the schorlaship scheme is part of her husband's vision to empower youth through education.She noted that her husband, who is the Chairman of Eleganza Group of Companies,RAO Property and other business concerns has been a great supporter of the educational sector through his philantropic gestures. He has been helping a lot of indigent students, he has also donated books and given support to various schools in the past.The students would get N100,000 each.

My friend and I use to joke that there are more Toyota cars in Lagos than any other brand.Aside the top range of master class design of the vehicles, the durability and top performance of Toyota cars can not be over estimated. 
Now the 2012 edition is here and we are sure that the top business people selling Toyota cars in Nigeria such as Chief Ade Ojo of Elizade Ojo are already jubilating because of the patronage they are going to enjoy. Well, the car has been unveiled in Nigeria.
 www.niyitabiti.blogspot.com gathered that the new 2012 Toyota camry is coming after the success of the 2007 edition of the same brand. The interior and the exterior of the camry come with resouding elegance and prestige.  It is simply designed for those who don't want to leave in the past, the 2012 auto is designed for the future.
 Specification of the vehicle as gathered from Yahoo! indicates the 2012 Camry is a 4-door, 5-passenger family sedan, available in 6 trims, ranging from the L to the XLE V6.
 Upon introduction, the L is equipped with a standard 2.5-liter, I4, 178-horsepower engine that achieves 25-mpg in the city and 35-mpg on the highway. The XLE V6 is equipped with a standard 3.5-liter, V6, 268-horsepower engine that achieves 21-mpg in the city and 30-mpg on the highway. A 6-speed automatic transmission with overdrive is standard on both trims.

BREAKING NEWS:OJUKWU IS DEAD

Chief Emeka Ojukwu, a former governor of the old eastern region is dead. Ojukwu, who has been hospitalised for moths died on his hospital bed in London, where he has been receiving treatment. Ojukwu who holds the title of Ikemba of Nnewi, amongst other titles would be given a state burial in Anambra State with the support of other governors in Igbo land. 
 Gistmaster gathered the federal government is also expected to play a pivotal role in the burial of the late elder stateman who led the Biafra war.
 Ojukwu's biography : Ojukwu was born in 1933 at Zugeru in the northern part of Nigeria to sir Louis Phillipe Ojukwu, one of Nigeria's richest men at that time. He was a radical who hates discrimination and cheating. The young Ojukwu got into trouble in 1944 for assaulting one his teachers- a whitewoman who matreated a black woman. 
After secondary school, Ojuwku studied History in the United Kingdom. On his return, Gistmaster, gathered that Ojukwu joined the Nigerian Army against his father's wish. He was one of the few graduates who enlisted in the army at that time. He rose to the position of governor eastern region (Controlling Igbo states).
 In 1967, he declared the eastern region a sovereign state , proclaiming that Igboland have secceded from Nigeria. He called it, Biafra Republic. This led to war between the federal forces and the Biafra Army. The war ended in 1970 with Ojukwu scampering abroad. He was later pardoned in durning the administration of Alhaji Sheu Shagari.
  He married his best friend's daughter, former Miss Bianca Onoh. Despite the refusal of Chief C.C Onoh's refusal to bless the wedding,Ojukwu and Bianca went on with thir love life. Ojuwku lost his friendship to Onoh while Bianca also lost her crown to the romance. The organizers of Most Beautiful Girl in Nigeria had to dethrown Bianca because of the controversies sorrouding her romance with the Ojukwu.
